The Supreme Court has directed the Central Bureau of Investigation (CBI) to open a preliminary enquiry into construction concerns at the DLF Primus housing project in Gurugram after allegations of deviation from the brochure shown to homebuyers. A bench of Justice Ahsanuddin Amanullah and Justice R. Mahadevan said projects must be delivered in accordance with representations to prospective buyers. The court noted that the 24-metre road shown in the plan did not exist as represented.\n\nCBI officer Saurabh Gupta was tasked to verify whether the road had been altered and filed a status report dated three August 2026 finding the road absent within the project. The material before the court showed parts of the earmarked area used for parking and other parts developed as a green track. The bench said the brochure and photographs left no doubt about the mismatch.\n\nThe bench described the deviation as substantial, noting that of the 147-metre stretch about 52 metres had been converted to a green patch and most of the remainder used for resident parking. It calculated that almost two-thirds of the stretch was unavailable as a road and questioned why the shortfall had not been remedied despite repeated opportunities. The court also criticised the state of Haryana for failing to acquire the 100-metre portion needed to link the site to the 60-metre sector road.\n\nThe CBI officer said he had two months from a July 21 order to submit the preliminary enquiry and requested extra manpower to expedite work, whereupon the bench asked the CBI Director to assign two additional inspectors to assist. The court warned it would pass appropriate orders at the next hearing if the project was not completed in accordance with the brochure and cautioned the state against further delay. The Additional Advocate General for Haryana was directed to file detailed replies. The matter will be heard on 12 October at three pm.
