Maharashtra Sets Two-Year Deadline for Housing Society Redevelopment

The Maharashtra government has introduced a time-bound framework for the redevelopment of cooperative housing societies, requiring developers to complete projects within two years of the first foundation or plinth certificate. The requirement forms part of revised guidelines issued under Section 79A of the Maharashtra Cooperative Societies Act.

The completion period can be extended to a maximum of three years in exceptional circumstances. The three-year period is not the standard timeline, and development agreements must include the applicable conditions governing the redevelopment project.

During construction, developers are required, as far as possible, to provide members with alternative accommodation in the same area. They can instead arrange monthly rent and a deposit acceptable to members, or provide suitable transit accommodation until the project is completed.

The revised rules also place greater emphasis on member participation, documentation and approval procedures. A redevelopment decision requires a two-thirds quorum and approval from at least 51 per cent of the society’s total members. Members voting in favour must provide written consent, while eligible participants, including senior citizens, people living abroad, critically ill members and people with disabilities, can join meetings through video conferencing or other remote systems.

Housing societies must invite at least three competitive bids from developers, although the deadline can be extended if fewer bids are received. Real estate representatives have said the two-year deadline could be workable for projects involving 18 to 20 floors, but taller developments may require more time for permissions and construction. Legal experts have said the final timeline will also depend on the development agreement, coordination between the society and developer, and the speed with which construction approvals are secured.
