Delhi HC directs NHSRCL to relook Montecarlo bid

On Monday, Delhi High Court ordered the National High-Speed Rail Corporation Ltd (NHSRCL) to take a relook on the tender put by Gujarat-based infrastructure firm Montecarlo Ltd for the design and building of civil and constructing works for India’s first bullet train undertaking.

NHSRCL is assigned to build the country's first bullet practice undertaking between Mumbai and Ahmedabad.

Now, the High Court has ordered the NHSRCL to continue underneath the tender course by further inspecting the bid of Montecarlo Ltd.

In this case, NHSRCL had floated a tender on October 22, 2020, for the design and development of civil and constructing works for the two depots on a design-build lump sum price basis for a double line high-speed railway in Gujarat. They covered works for retaining walls, cable duct, abutment, site development, ox culvert, roads, general inspection train shed and maintenance depot at Sabarmati. The project cost is above Rs 350 crore.

The bullet train project authority denied the tender by Montecarlo, and the contract was granted to SCC-VRS (JV).

However, Montecarlo Ltd claimed in its petition that it received a communication from the Rail Corporation refusing its tender, together with four different bidders. When the corporation asked for an explanation for the refusal, the NHSRCL termed the tender as non-responsive.

Montecarlo had challenged the communication on the Delhi High Court and claimed that the respondent (NHSRCL) is working in an arbitrary and non-transparent way. That it has unjustly managed the petitioner (Montecarlo).

The High court has directed the authority to consider its tender for the contract following the law.
