HC Refuses Stay On MHADA Redevelopment Tender

Bombay High Court has refused to grant an interim stay on the Maharashtra Housing and Area Development Authority (MHADA) redevelopment tender after finding that the bidding process has reached an advanced stage. The court observed that halting the tender at this point would cause prejudice to participants and could undermine the competitive procurement timeline. Petitioners had challenged aspects of the tender but the bench weighed the public interest in timely redevelopment against the claims raised.

The decision came during hearings in which MHADA outlined the schedule for evaluation and award and said cancelling the process would impose costs and delay housing delivery. The court indicated that procedural irregularities could be addressed through the adjudicatory route while allowing procurement to continue. Lawyers on both sides made submissions on technical and administrative points and the bench asked the parties to place records before the court to aid a swift resolution as well.

MHADA recently said several developers had submitted bids and that the evaluation phase was under way, prompting the court to consider the interests of bona fide bidders who had invested time and resources. The bench emphasised the need to maintain procurement integrity while recognising that grievances could be addressed in the judicial process. The case will return for further consideration, with the court intending to expedite hearings to avoid needless delay and protect public interest.
