The Brihanmumbai Municipal Corporation (BMC) has issued a Standard Operating Procedure (SOP) for its Occupation Certificate (OC) amnesty scheme, clarifying eligibility requirements for housing societies with buildings that do not have an OC.Under the scheme, buildings must have a valid Intimation of Disapproval (IOD), approved plans and a Commencement Certificate (CC). Housing societies will also need an NOC from the original owner, developer or applicant holding development rights. If the required NOC is not provided, BMC can issue a notice to the concerned party. The scheme applies to buildings occupied before November 17, 2016, with societies required to submit documents such as property tax receipts or electricity bills to establish the date of occupation. Residential units exceeding 80 sq m, or about 861 sq ft, are excluded from the scheme. The amnesty is intended to help regularise the OC status of eligible buildings but does not permit illegal construction or other violations to be regularised. BMC estimates that around 12 lakh homeowners across nearly 25,000 residential buildings could potentially benefit.
